Federal appeals court reinstates criminal convictions of Hunter Biden's business partner

The United States Court of Appeals for the Second Circuit on Wednesday reversed a lower court decision to grant a new trial in a fraud case involving Hunter Biden's ex-business partner Devon Archer.

Hunter Biden was not charged in the scheme, but Biden's name was reportedly "invoked at various stages of the fraud as a selling point in transactions."

Archer was indicted on March 26, 2018 and charged with conspiracy to commit securities fraud and securities fraud for a Native American tribal bond scheme hatched by Archer and several of his business partners. After a trial lasting approximately one month, the jury found Archer guilty on both counts. Archer asked the district court to set aside the jury's verdict and successfully pushed for a retrial.

Now, the Second Circuit Court of Appeals has reinstated the jury's conviction and sent the Archer case back to district court for sentencing. The court summarized the decision as follows: "Because the weight of the evidence presented at trial did not preponderate heavily against the jury's verdict, we find that the district court abused its discretion in vacating the judgment and granting a new trial. Accordingly, the decision of the district court is REVERSED, and the jury verdict is reinstated. The case is REMANDED to the district court for sentencing."

Financial records made public during Archer's 2018 trial revealed large sums of Chinese and Ukrainian money flowing into Archer's and Biden's accounts via a Morgan Stanley account for an entity called Rosemont Seneca Bohai, LLC (RSB). For example, the RSB financial records revealed that Ukraine's largest gas company, Burisma Holdings, funneled millions to Archer and Biden in 2014 and 2015. According to Archer's bank statement, Burisma paid at least $166,666.66 (twin payments of $83,333.33) into Biden and Archer's joint account each month between May 2014 and October 2015.

Archer's bank statement released in the trial also revealed that the China state-owned Bank of China directly funneled more than $100,000 into the same account as Burisma beginning in December 2014. Another entity, Novatus Holding Pte. Ltd., wired $142,300 to the Rosemont account on April 22, 2014. That entity is controlled by a Kazakh businessman named Kenges Rakishev who has close ties to the leaders of Kazakhstan.

Many of the financial records revealed during Archer's 2018 trial became the subject of a joint Senate committee investigation. The GOP-led investigation slammed the Bidens and their associates for apparent conflicts of interest and flagged possible criminal activity while citing "glaring" evidence of Burisma bribes, suspicious foreign money transfers and sex trafficking.

In addition to Archer's financial records, the Senate report cited nonpartisan Treasury Department documents called Suspicious Activity Reports, which are generated by financial institutions when transactions appear suspicious or money-laundering is suspected.

"Treasury records acquired by the Chairmen show potential criminal activity relating to transactions among and between Hunter Biden, his family, and his associates with Ukrainian, Russian, Kazakh and Chinese nationals," the 87-page report disclosed, confirming an earlier report in Just the News.

"The report raises serious questions that former Vice President Biden needs to answer," Sen. Ron Johnson (R-Wisc.) told Just the News. "There are simply too many potential conflicts of interest, counterintelligence and extortion threats to ignore."

Archer's attorney, Matthew L. Schwartz of Boies Schiller Flexner LLP, stated: "Yesterday's ruling, which second-guesses that judge's decision without having sat through the evidence and listened to the witnesses, is beyond disappointing."

Hunter Biden introduced his father, then-Vice President Joe Biden, to a top executive at a Ukrainian energy firm less than a year before the elder Biden pressured government officials in Ukraine into firing a prosecutor who was investigating the company, according to emails obtained by The Post.

The never-before-revealed meeting is mentioned in a message of appreciation that Vadym Pozharskyi, an adviser to the board of Burisma, allegedly sent Hunter Biden on April 17, 2015, about a year after Hunter joined the Burisma board at a reported salary of up to $50,000 a month.

“Dear Hunter, thank you for inviting me to DC and giving an opportunity to meet your father and spent [sic] some time together. It’s realty [sic] an honor and pleasure,” the email reads.

An earlier email from May 2014 also shows Pozharskyi, reportedly Burisma’s No. 3 exec, asking Hunter for “advice on how you could use your influence” on the company’s behalf.

Other material extracted from the computer includes a raunchy, 12-minute video that appears to show Hunter, who’s admitted struggling with addiction problems, smoking crack while engaged in a sex act with an unidentified woman, as well as numerous other sexually explicit images.

The customer who brought in the water-damaged MacBook Pro for repair never paid for the service or retrieved it or a hard drive on which its contents were stored, according to the shop owner, who said he tried repeatedly to contact the client.

The shop owner couldn’t positively identify the customer as Hunter Biden, but said the laptop bore a sticker from the Beau Biden Foundation, named after Hunter’s late brother and former Delaware attorney general.

Photos of a Delaware federal court subpoena given to The Post show that both the computer and hard drive were seized by the FBI in December, after the shop’s owner says he alerted the feds to their existence.

But before turning over the gear, the shop owner says he made a copy of the hard drive and later gave it to former Mayor Rudy Giuliani’s lawyer, Robert Costello.

Steve Bannon, former adviser to President Trump, told The Post about the existence of the hard drive in late September and Giuliani provided The Post with a copy of it on Sunday.

Less than eight months after Pozharskyi thanked Hunter Biden for the introduction to his dad, the then-vice president admittedly pressured Ukrainian President Petro Poroshenko and Prime Minister Arseniy Yatsenyuk into getting rid of Prosecutor General Viktor Shokin by threatening to withhold a $1 billion US loan guarantee during a December 2015 trip to Kiev.

“I looked at them and said: I’m leaving in six hours. If the prosecutor is not fired, you’re not getting the money,” Biden infamously bragged to the Council on Foreign Relations in 2018.

“Well, son of a bitch. He got fired.”

Shokin has said that at the time of his firing, in March 2016, he’d made “specific plans” to investigate Burisma that “included interrogations and other crime-investigation procedures into all members of the executive board, including Hunter Biden.”

Joe Biden has insisted that the US wanted Shokin removed over corruption concerns, which were shared by the European Union.

Meanwhile, an email dated May 12, 2014 — shortly after Hunter Biden joined the Burisma board — shows Pozharskyi attempting to get him to use his political leverage to help the company.

The message had the subject line “urgent issue” and was also sent to Hunter Biden’s business partner, Devon Archer, who also sat on the Burisma board at the time.

N.Z. isn’t identified in the email but appears to be a reference to Burisma founder Mykola Zlochevsky, whose first name is a Ukrainian version of “Nicholas.”

When the alleged shakedown failed, “they proceeded with concrete actions” in the form of “one or more pretrial proceedings,” Pozharskyi wrote.

“We urgently need your advice on how you could use your influence to convey a message / signal, etc .to stop what we consider to be politically motivated actions,” he added.

Hunter Biden responded by saying he was with Archer in Doha, Qatar, and asked for more information about “the formal (if any) accusations being made against Burisma.”

“Who is ultimately behind these attacks on the company? Who in the current interim government could put an end to such attacks?” he added.

Hunter Biden actually joined the board in April 2014, according to multiple reports.

His lawyer said last year that Hunter was “not a member of the management team,” adding, “At no time was Hunter in charge of the company’s legal affairs.”

About four months after Hunter Biden’s correspondence with Pozharskyi, Archer forwarded Hunter Biden an email chain with the subject line “tax raise impact on Burisma production,” that included Pozharskyi saying that the Ukrainian Cabinet had submitted new tax legislation to the country’s parliament.

“If enacted, this law would kill the entire private gas production sector in the bud,” Pozharskyi wrote.

In the Sept. 24, 2014, email, Pozharskyi also said he was “going to share this information with the US embassy here in Kyiv, as well as the office of Mr Amos Hochstein in the States.”

At the time, Hochstein was the State Department’s newly appointed special envoy and coordinator for international energy affairs.

In December 2017, the Naftogaz Group, Ukraine’s state-owned energy company, announced that Hochstein had joined the company as an independent director, but on Monday he announced his resignation.

“The company has been forced to spend endless amounts of time combating political pressure and efforts by oligarchs to enrich themselves through questionable transactions,” Hochstein wrote in an op-ed published by the Kyiv Post.

In addition to denying that’s he’s spoken to Hunter Biden about his overseas business dealings, Joe Biden has repeatedly denied any conflict of interest or wrongdoing by either of them involving Burisma.

Last February, he got testy during an appearance on NBC’s “Today” show when co-host Savannah Guthrie questioned whether it was “wrong for [Hunter] to take that position, knowing that it was really because that company wanted access to you.”

“You’re a damn liar, man. That’s not true and no one has ever said that,” Biden fumed.

Biden then continued berating the man as he stepped forward, called the man “fat” and challenged him to “do push-ups together, man.”

The FBI referred questions about its seizure of the laptop and hard drive to the Delaware US Attorney’s Office, where a spokesperson said, “My office can neither confirm nor deny the existence of an investigation.”

Hunter Biden’s lawyer refused to comment on the specifics but instead attacked Giuliani.

The Obama administration let a Democratic p.r. company that worked for Ukrainian energy firm Burisma take part in a conference call about an upcoming visit to Ukraine by then-Vice President Joe Biden, emails obtained by The Post show.

An associate at Blue Star Strategies then emailed a memo with minutes of the conference call hosted by the White House to a top Burisma executive, Vadym Pozharskyi, as well as to Joe Biden’s son, Hunter, and Hunter’s business partner, Devon Archer, both of whom sat on Burisma’s board.

The trip, in December 2015, turned out to be the one during which Biden later bragged about forcing Ukrainian officials to fire a state prosecutor who was investigating Burisma by threatening to withhold a $1 billion US loan guarantee.

The memo, sent shortly after the Dec. 2, 2015, call, also “outlined the trip’s agenda and addressed several questions regarding US policy toward Ukraine.”

Blue Star has said it began working for Burisma and contacting Ukrainian officials on its behalf in November 2015, and an email shows that on Nov. 18, 2015, Pozharskyi sent the Blue Star contract to Hunter Biden, Archer and Eric Schwerin, president of the Rosemont Seneca Partners investment firm.

Hunter Biden and Archer were among RSP’s founders, along with former Secretary of State John Kerry’s stepson, Christopher Heinz, Reuters has reported.

This stuff has already been disclosed. This very thread or one of the many has posts implicating Pelosi, Kerry’s stepson, Romney’s, Schiff. They are ALL ass deep in this thing.

That’s why so many are discouraged. The info gets out. And the Swamp gets its tentacles on it and subverts and buries it.
The FBI had this laptop in the summer of ‘19!!!!!!


Let that sink in.

They tried to bury it. Only when the repair guy couldn’t take it any longer with the fake impeachment did he bring his copy to an associate who knew Guilliani and put his last hopes at full disclosure into someone’s hands he knew had the Presidents back.

They would’ve sat on this info.

Not everything you hear is untrue and not every story is complex. At the heart of the growing Biden-Ukraine scandal, for example, is a very straightforward question: Did Joe Biden subvert American foreign policy in order to enrich his own family?

In 2015, Joe Biden was the sitting vice president of the United States. Included in his portfolio were U.S. relations with the nation of Ukraine. At that moment, Vice President Joe Biden had more influence over the Ukrainian government and the Ukrainian economy than any other person on the globe outside of Eastern Europe.

Biden's younger son, Hunter, knew that and hoped to get rich from his father's influence. Emails published Wednesday by The New York Post, documents apparently taken directly from Hunter Biden's own laptop, tell some of that story.

"Tucker Carlson Tonight" have obtained another batch of emails, some exclusively. We believe they also came from Hunter Biden's laptop. We can't prove that they did, we haven't examined that computer. But every detail that we could check, including Hunter Biden's personal email address at the time, suggests they are authentic.

If these emails are fake, this is the most complex and sophisticated hoax in history. It almost seems beyond human capacity. The Biden campaign clearly believes these emails are real. They have not said otherwise. We sent the body of them to Hunter Biden's attorney and never heard back. So with that in mind, here's what we have learned.

On Nov. 2, 2015, at 4:36 p.m., a Burisma executive called Vadym Pozharskyi emailed Hunter Biden and his business partner, Devon Archer. The purpose of the email, Pozharskyi explains, is to "be on the same page re our final goals ... including, but not limited to: a concrete course of actions."

So what did Burisma want, exactly? Well, good PR, for starters. Pozharskyi wanted "high-ranking US [sic] officials" to express their "positive opinion" of Burisma, and then he wanted the administration to act on Burisma's behalf.

"The scope of work should also include organization of a visit of a number of widely recognized and influential current and/or former US [sic] policy-makers to Ukraine in November, aiming to conduct meetings with and bring positive signal/message and support" to Burisma.

The goal, Pozharskyi explained, was to "close down for [sic] any cases/pursuits" against the head of Burisma in Ukraine.

BIDEN CAMP HITS BACK AT HUNTER BIDEN EMAIL REPORT

It couldn't be clearer what they wanted. Burisma wanted Huter Biden's father to get their company out of legal trouble with the Ukrainian government. And that's exactly what happened. One month later to the day, on Dec. 2, 2015, Hunter Biden received a notice from a Washington PR firm called Blue Star Strategies, which apparently had been hired to lobby the Obama administration on Ukraine. "Tucker Carlson Tonight" have exclusively obtained that email.

"Hello all ..." it began. "This morning, the White House hosted a conference call regarding the Vice President's upcoming trip to Ukraine. Attached is a memo from the Blue Star Strategies team with the minutes of the call, which outlined the trip's agenda and addressed several questions regarding U.S. policy toward Ukraine."

So here you have a PR firm involved in an official White House foreign policy call. How could that happen? Good question. But it worked.

Days later, Joe Biden flew to Ukraine and did exactly what his son wanted. The vice president gave a speech slamming the very Ukrainian law enforcement official who was tormenting Burisma. If the Ukrainian government didn't fire its top prosecutor, a man called Viktor Shokin, Biden explained, the administration would withhold a billion dollars in American aid. Now, Ukraine is a poor country, so they had no choice but to obey. Biden's bullying worked. He bragged about it later.

The obvious question: Why was the vice president of the United States threatening a tiny country like Ukraine to fire its top prosecutor? That doesn't seem like a vice president's role. Well, now we know why.

Viktor Shokin has signed an affidavit affirming that he was, in fact, investigating Burisma at the moment Joe Biden had him removed. Shokin said that before he was fired, administration officials pressured him to drop the case against Burisma. He would not do that, so Joe Biden canned him.

That's how things really work in Washington. Your son's got a lucrative consulting deal with a Ukrainian energy company, you tailor American foreign policy -- our foreign policy-- to help make him rich. Even at the State Department, possibly the most cynical agency in government, this seemed shockingly brazen.

During the impeachment proceedings last fall, a State Department official named George Kent said it was widely known in Washington that the Bidens were up to something sleazy in Ukraine.

FLASHBACK: STATE DEPARTMENT OFFICIAL FLAGGED HUNTER BIDEN'S 'CONFLICT OF INTEREST IN UKRAINE

"I was on a call with somebody on the vice president's staff and ... I raised my concerns that I had heard that Hunter Biden was on the board" of Burisma, Kent recalled. This, he noted, could create a perception of a conflict of interest.

So how did the vice president's office respond to this concern? According to George Kent, "The message that I recall hearing back was that the vice president's son, Beau, was dying of cancer and there was no further bandwidth to deal with family-related issues at the time."

Family-related issues? This was America's foreign policy being tailored to Joe Biden's son. Five years later, Joe Biden still has not been forced to explain why he fired Ukraine's top prosecutor at precisely the moment his son was being paid to get him to fire Ukraine's top prosecutor, nor has Joe Biden addressed whether or not he personally benefited from the Burisma contract.

But there are tantalizing hints. On Wednesday, former New York City Mayor Rudy Giuliani published what he said was yet another email from Hunter Biden's laptop. It's a note to one of his children. At the end of the email, there's this quote: "But dont [sic] worry unlike Pop I won't make you give me half your salary."

What does that mean, exactly? Well, we don't know. There may be more detail on the laptop, but unfortunately, we don't have access to that. But the question remains, how has Joe Biden lived in extravagance all these years on a government salary? No one has ever answered that question. And the tech monopolies are working hard to make certain no one ever does.

Thursday morning, the New York Post published another story based on the emails. This one describes a business venture Hunter Biden was working on in China. One email describes a "provisional agreement that the equity will be distributed as follows ... 10 held by H for the big guy?"

The big guy? Is the big guy Joe Biden? If so, how much did Joe Biden get and how much of that came from the Communist Chinese government? Those are real questions, this man could be elected president in three weeks. But Twitter doesn't want you to wonder. It won't allow you to ask those questions. Twitter restricted the New York Post story as "unsafe," like it was a lawn dart or a defective circular saw. And that was enough for the Biden campaign.

So the tech monopoly censors information to help their candidate, that candidate uses that censorship to dismiss the story. One hand washes the other.

They worship power and they don't need to be consistent. Melania Trump's private phone conversations, the president's stolen tax returns, they were happy to publish all of that. But if you criticize the Democratic candidate, their candidate, you are banned.

"Facebook and Twitter have policies to not spread things that are utterly unreliable, that have been debunked, and where their origin is untrustworthy," Sen. Chris Coons, D-Del., said Thursday. "They're practicing their own internal controls, as I wish they had over the past four years ... An active Russian disinformation campaign in 2016 had an influence on that election. They are trying even harder in this election. I'm glad that they are managing the content on their own websites."

Chris Coons is a liar.

Not one word of this story has been debunked, not one word in those emails has been "debunked." And if it is debunked, we'll be the first to report it because we're not liars. But did you catch the phrase he wanted you to hear: "Russian disinformation"? That's what they're claiming these emails are. And it's all over the Internet, in fact-free, conspiracy-laden conjecture crazier than anything the QAnon people ever thought of.

But none of their garbage, their lunatic lies about Russia is ever censored by the tech monopolies. It's not "unsafe" because it helps Joe Biden. Therefore, you can read it.

And where are the real journalists, now that we need them more than ever? They're gone. They're cowering. They're afraid. They don't want to upset power. Jake Sherman of Politico, who claims to be a news reporter, actually apologized on Twitter for asking the Biden campaign about Hunter Biden's emails. These people are craven. They have no standards. They have no self-respect. Like their masters in Silicon Valley, they worship power alone.

What did Joe Biden know about Hunter's crook emails?: Goodwin​

Asked Friday by a CBS reporter to respond to The Post’s reports, the Democrat called it a “smear campaign” and berated the reporter for asking the question.

That’s not going to work. Good reporters won’t be intimidated, and voters are likely to smell a rat if he’s not willing to answer legitimate questions.

By now, Biden should know that there are no such things as stupid questions, only stupid answers.

Moreover, President Trump is certain to accuse Biden of rampant corruption at Thursday’s debate, so the Dem needs a better explanation or the issue could mushroom in a matter of days.

The developments are also a test for the Big Media and Big Tech companies that operate a Biden protection racket. Facebook and Twitter blocked users from sharing The Post’s initial reports, an outrageous example of political meddling. For their efforts, the companies were rewarded with congressional subpoenas to testify this week.

CNN, The New York Times and the broadcast networks are trying to help Biden by ignoring the story or knocking it down. Washington Post columnist David Ignatius went full bore Saturday for the defense by offering the preposterous view that the Burisma tale “isn’t a scandal but part of a personal tragedy for the vice president’s son, compounded by this week’s dissemination of what looks like disinformation about Joe Biden’s role.”

It’s true that Hunter Biden’s drug-addled life is worthy of sympathy, but that doesn’t absolve him of grifting off his father’s government power and certainly doesn’t absolve his father if he violated his oath of office and public trust.

As for Ignatius’ disinformation claim, that would be Russian disinformation no doubt. The whole thing is just Vladimir Putin trying to help his top American agent, Donald Trump, right?

That was the Deep State’s line in 2016, and it worked so well then. Just ask President Hillary Clinton.

The Biden Corruption Scandal Isn’t About Hunter, It’s About Joe​

The Hunter Biden scandal indicates that Joe Biden, while vice president of the United States, knowingly allowed his son to sell access to the Obama administration, then lied about it.​

Hunter Biden’s addiction is not the issue. Joe Biden’s addiction is: His addiction to power and money. And it is the evidence of the former vice president’s corruption, and the national security risk our country would face by electing Biden, that is the story of the MacBook hard drive, not the salacious, verified photographs and videos of Hunter Biden.

For nearly a week, corporate media successfully ignored or downplayed news of the trove of Hunter Biden’s emails, texts, photographs, and videos recovered from a laptop abandoned at a Delaware computer repair store. Then confirmation of the authenticity of the materials first reported in the New York Post, and the release of a second set of emails — also confirmed— from another source finally forced the press to acknowledge the issue.

On Friday evening, CBS News’ Bo Erickson asked Joe Biden about the New York Post story as the Democrat candidate for president departed from a campaign stop in Michigan. “I have no response. It’s another smear campaign — right up your alley, those are the questions you always ask,” Biden snipped at the long-time reporter.

With more details coming out daily, this non-answer will not placate even a compliant press for long. Nor will the “Russia disinformation” narrative pushed by Biden’s media boosters suffice because multiple confirmations of the evidence establish this story is not disinformation.

It’s Not about Hunter’s Addiction, It’s about Joe’s​

So, the dissembling will start, with Biden attempting to make the story about his son’s drug addiction. We already saw this when President Trump hit his opponent during the first presidential debate with the fact that once Biden “became vice president [Hunter] made a fortune in Ukraine, in China, in Moscow and various other places.” Biden’s first response was outright denial: “That is not true.” But that won’t work with the constantly accumulating evidence from the hard drive and the other independent emails.

So Biden’s second tack will likely be his campaign’s official response once they regroup over the weekend: “My son, like a lot of people at home, had a drug problem. He’s overtaking it. He’s fixed it. He’s worked on it. And I’m proud of him, I’m proud of my son,” Biden punched back during the first presidential debate.

Wisely, President Trump ignored the misdirection, replying, “But why was he given tens of millions of dollars?” “Moderator” Chris Wallace rescued Biden by interjecting, “We’ve already been through this. I think the American people would rather hear about more substantial subjects. Well, as the moderator, sir, I’m going to make a judgment call here.”

Senate Report Confirms Corruption​

While Hunter Biden’s highly lucrative position on the board of the Ukrainian company Burisma has received some press, the media all but ignored the U.S. Senate committee report on “Hunter Biden, Burisma, and Corruption: The Impact on U.S. Government Policy and Related Concerns.” This report not only details “examples of extensive and complex financial transactions involving the Bidens, it also describes the quandary other U.S. governmental officials faced as they attempted to guide and support Ukraine’s anticorruption efforts.”

The report’s key findings included concerns raised by “officials in Vice President Joe Biden’s office about the perception of a conflict of interest with respect to Hunter Biden’s role on Burisma’s board,” and a senior State Department official’s warning to Vice President Biden or his staff “that Hunter Biden’s position on Burisma’s board enabled Russian disinformation efforts and risked undermining U.S. policy in Ukraine.” The report also confirmed that former Secretary of State John Kerry “had knowledge of Hunter Biden’s role on Burisma’s board,” even though he falsely denied that knowledge during a town hall event in 2019.

The report was not limited to Hunter Biden’s role on the Burisma board and the Obama-Biden administration’s knowledge of that conflict of interest. The Senate committees also detailed Hunter’s receipt of “a $3.5 million wire transfer from Elena Baturina, the wife of the former mayor of Moscow,” and Hunter’s opening of “a bank account with Gongwen Dong to fund a $100,000 global spending spree with James Biden and Sara Biden,” as well as his “business associations with Ye Jianming, Gongwen Dong, and other Chinese nationals linked to the Communist government and the People’s Liberation Army.”

“Those associations,” the report continued, “resulted in millions of dollars in cash flow,” some of which Hunter “paid nonresident women who were nationals of Russia or other Eastern European countries and who appear to be linked to an ‘Eastern European prostitution or human trafficking ring.’”

Whistleblower Turns Over Hunter’s Laptop​

Then on Saturday, we learned from a letter sent by Sen. Ron Johnson, the chair of the Senate Homeland Security and Governmental Affairs Committee, to FBI Director Christopher Wray, that the report triggered “a whistleblower” to contact Johnson’s “committee and informed [his] staff that he had possession of a laptop left in his business by Hunter Biden,” clearly the same source as behind the New York Post’s story.

The letter continued: “He also informed us that he provided its contents to the Federal Bureau of Investigation (FBI) in response to a December 9, 2019 grand jury subpoena.” The FBI refused to confirm any or deny any information sought by the committee, including questions unrelated to ongoing grand jury investigations. Johnson stressed the importance of the FBI responding to the committee’s inquiry: “I have a responsibility to validate and verify the contents of any information produced to my committee. The committee must know if it receives information that could be fraudulent or not accurate.”

“For example,” Johnson’s letter continued, “if any information offered to the committee was linked to a foreign adversary’s attempt to interfere in the election, I would expect the FBI to ensure the committee is protected and receives a defensive briefing.” Additionally, as Johnson noted, “knowingly providing false information to Congress is a crime.” Johnson then listed a litany of questions concerning the laptop and the FBI’s efforts to verify the authenticity of the material, asking for an answer by Oct. 22, 2020.

It seems unlikely the FBI will respond to the inquiry, or at least not publicly, but to date, several outlets are claiming they confirmed the validity of the emails and other material on the hard drive, and the personal texts and photographs and videos released leave little doubt that the hard drive truly was Hunter Biden’s.

This Is about Joe Biden, Not Hunter​

That is the extent of the relevance of the personal information being released: The public does not need to know of the unsavory and illegal behavior Hunter engaged in—much less watch it—while he was in the throes of addiction. America also does not need to read the words of anguish exchanged between an addict son undergoing rehab and his famous father.

Yet Hunter Biden’s addiction, and the fact that tens of thousands of other Americans suffer similar demons, does not atone for the sins of the father. And that is what the email and text scandal concerns: Evidence that Joe Biden, while vice president of the United States, knowingly allowed his son to profit by selling access to Biden and others in the Obama administration, including to Communist Party of China leaders, and then lied about it.

The emails and texts Joe personally received also suggest a cut from Hunter’s influence-peddling. For instance, one email published by the New York Post detailed a deal Hunter Biden pursued with China’s largest private energy company that was “interesting for me and my family.”

A May 13, 2017 email with the subject line “Expectations” listed expected “renumeration packages” for various individuals, including “‘H,’ apparently referring to Biden.” The Post noted that “the deal also listed ‘10 Jim’ and ‘10 held by H for the big guy?’” but did not identify the “big guy.” However, sources have told Fox News “‘the big guy’ is a reference to the former vice president.”

A text recovered from the hard drive also suggests the former vice president may have received a cut of Hunter’s “earnings.” “I Hope you all cal do what I did and pay for everything for this entire family Fro 30 years,” a screenshot of a text from January 2019 to Hunter’s daughter read. “It’s really hard. But don’t worry unlike Pop I won’t make you give me half your salary.”

This Compromising Material Is a National Security Risk​

Evidence of this scandal is too strong to ignore or to allow Joe Biden, the Democratic Party, or corporate media to cast aside as an unseemly attack on a recovering drug addict, and not merely because of the corruption at issue. Every country, every foreign politician or political faction, and every corrupt oligarch or business that paid for access has the emails, notes, receipts, itineraries, fund transfers, and maybe even photographs or recordings. And that makes Joe Biden a national security risk.

Remember, it was Acting Attorney General Sally Yates’ concern that then-National Security Advisor Michael Flynn was a national security risk that sent her to the White House to get him fired. The Russians would know, she maintained, that Flynn had misrepresented to Vice President Mike Pence his conversations with the Russian ambassador, and that would leave Flynn compromised. Of course, that theory was so preposterous that even disgraced former FBI Director James Comey called it a stretch.

But there is a world of difference between a conversation among a transition team member and a foreign ambassador and a conversation between individuals with foreign interests and the former vice president, bought and paid for with cash funneled through his son. A compromise of that kind holds serious national security issues, which is why our country needs a full vetting of this evidence.

If the emails and texts are fake, we need to know that. But all indications to date are that they are real, and spectacularly damning. And that has nothing to do with Hunter Biden’s addiction, and everything to do with Joe Biden’s unfitness for office.

Exclusive — Peter Schweizer: Hunter Biden’s Flipped Business Partner Provided 26,000 Emails​

The business partner of Hunter Biden who flipped on the Biden family from prison provided access to 26,000 emails, Breitbart News senior contributor Peter Schweizer said in a Saturday morning radio appearance.

Schweizer, appearing on Breitbart News Saturday on SiriusXM 125 the Patriot Channel, said that former Hunter Biden business partner Bevan Cooney provided 26,000 emails to him—the first of which were published late last week in a Breitbart News exclusive investigation by Schweizer and author Seamus Bruner. Cooney is currently serving a sentence in federal prison due to his conviction over financial deals he made connected to Hunter Biden and his other partner Devon Archer. Archer, who was also convicted by a jury in federal court, saw his conviction vacated by a federal judge. That conviction was later—just a couple weeks ago—reinstated by an appellate court, which overruled the lower court judge’s decision to vacate it. Archer awaits sentencing.



In the meantime, however, Cooney—who is serving his sentence in federal prison—reached out to Schweizer via conservative journalist Matthew Tyrmand and provided written authorization to access his Gmail account. He provided the password and username, and written authorization to publish emails because Schweizer says he believes he was the “fall guy” for the Biden family’s corruption and that he believes the public needs to know what really happened in Hunter Biden’s universe. The first article on these emails was published Friday afternoon, and detailed how Hunter Biden and his partners secured meetings with senior White House officials in November 2011 for Chinese Communist elites—including, as the Chinese elites who were present revealed, a secret meeting with then-Vice President Joe Biden himself. The Biden campaign has not responded to requests for comment about this from Breitbart News.

“Bevan Cooney was business partners with Hunter Biden and Devon Archer,” Schweizer said on Breitbart News Saturday. “He was a nightclub owner—he owns the Viper Room in Los Angeles, and got involved in these financial deals. He ended up going to jail and really feels that he was the fall guy. Devon Archer is now going to be going to jail as well, because of the same deals, but he [Cooney] really feels like Hunter Biden was able to walk off scot-free. He had reached out to me in 2019 after my book Secret Empires came out in 2018. He talked about sharing his emails, but it never happened. He ended up going to jail. He recently reached out through Matt Tyrmand, a journalist, and said I want to give you access to all of my emails in my Gmail account. He gave us written approval to do that, and gave us the password. We have been going through the 26,000 emails. The article that we ran on Breitbart, about China, Inc., is the first of what are going to be several. In this particular story what we lay out is how Hunter Biden and his business partners set up a meeting for this group called the China Entrepreneurs Club. Don’t let that benign name fool you; this is regarded as joined at the hip with the Chinese communist government. This China Entrepreneurs Club wanted meeting at the highest levels of the White House and Hunter Biden arranged them. What’s very curious about this is not only that they got these meetings on November 14, 2011, but they actually, according to members, had a private, secret meeting with Joe Biden himself. We don’t know about this because it appeared on the White House visitors logs or the White House calendar—it doesn’t. We know about it because the Chinese that were on that trip bragged about it in their blog posts back in China that they had this private, secret meeting with Joe Biden. Out of that sprang relationships and business deals that Hunter Biden and his business partners were apparently able to take advantage of, so it demonstrates how this access, with the participation of Joe Biden, translated into commercial deals down the road.”



Schweizer said this first round of emails published late last week—only a handful of the 26,000 obtained—is just the beginning. There are more, he said, including ones that further illustrate the relationship between Hunter Biden and the ex-wife of the former Moscow mayor Yelene Baturina—a payment from her to Hunter Biden was a major revelation in a recent U.S. Senate report on the Biden family corruption—as well as a clearer, more vivid description of just how the Bidens worked to develop a system to use Joe Biden’s position in government to enrich themselves.

“The emails, there are different types of emails,” Schweizer said. “Many of the emails are the business partners discussing, without Hunter’s participation, what Hunter’s role is in all of this. What’s very clear, and we will have reporting on this at Breitbart, what’s very clear is Hunter brings no money to the table. But he is considered the avenue to the administration. There are emails that talk about how they are going to do business deals where they want to get union pension money and that Hunter is going to leverage the relationships that his dad has with public employee unions to get that money. So part of it is just kind of a feel for what is the Biden business model, and we kind of knew this in a way but here it’s very explicit that it is trading off the Biden name, the Biden connections, and the Biden access. The other way I would categorize this is geographical. The one we have already broke was a story related to China. There are other emails involving China. The business partner of Hunter Biden who flipped on the Biden family from prison provided access to 26,000 emails, Breitbart News senior contributor Peter Schweizer said in a Saturday morning radio appearance.

Schweizer, appearing on Breitbart News Saturday on SiriusXM 125 the Patriot Channel, said that former Hunter Biden business partner Bevan Cooney provided 26,000 emails to him—the first of which were published late last week in a Breitbart News exclusive investigation by Schweizer and author Seamus Bruner. Cooney is currently serving a sentence in federal prison due to his conviction over financial deals he made connected to Hunter Biden and his other partner Devon Archer. Archer, who was also convicted by a jury in federal court, saw his conviction vacated by a federal judge. That conviction was later—just a couple weeks ago—reinstated by an appellate court, which overruled the lower court judge’s decision to vacate it. Archer awaits sentencing.



In the meantime, however, Cooney—who is serving his sentence in federal prison—reached out to Schweizer via conservative journalist Matthew Tyrmand and provided written authorization to access his Gmail account. He provided the password and username, and written authorization to publish emails because Schweizer says he believes he was the “fall guy” for the Biden family’s corruption and that he believes the public needs to know what really happened in Hunter Biden’s universe. The first article on these emails was published Friday afternoon, and detailed how Hunter Biden and his partners secured meetings with senior White House officials in November 2011 for Chinese Communist elites—including, as the Chinese elites who were present revealed, a secret meeting with then-Vice President Joe Biden himself. The Biden campaign has not responded to requests for comment about this from Breitbart News.

“Bevan Cooney was business partners with Hunter Biden and Devon Archer,” Schweizer said on Breitbart News Saturday. “He was a nightclub owner—he owns the Viper Room in Los Angeles, and got involved in these financial deals. He ended up going to jail and really feels that he was the fall guy. Devon Archer is now going to be going to jail as well, because of the same deals, but he [Cooney] really feels like Hunter Biden was able to walk off scot-free. He had reached out to me in 2019 after my book Secret Empires came out in 2018. He talked about sharing his emails, but it never happened. He ended up going to jail. He recently reached out through Matt Tyrmand, a journalist, and said I want to give you access to all of my emails in my Gmail account. He gave us written approval to do that, and gave us the password. We have been going through the 26,000 emails. The article that we ran on Breitbart, about China, Inc., is the first of what are going to be several. In this particular story what we lay out is how Hunter Biden and his business partners set up a meeting for this group called the China Entrepreneurs Club. Don’t let that benign name fool you; this is regarded as joined at the hip with the Chinese communist government. This China Entrepreneurs Club wanted meeting at the highest levels of the White House and Hunter Biden arranged them. What’s very curious about this is not only that they got these meetings on November 14, 2011, but they actually, according to members, had a private, secret meeting with Joe Biden himself. We don’t know about this because it appeared on the White House visitors logs or the White House calendar—it doesn’t. We know about it because the Chinese that were on that trip bragged about it in their blog posts back in China that they had this private, secret meeting with Joe Biden. Out of that sprang relationships and business deals that Hunter Biden and his business partners were apparently able to take advantage of, so it demonstrates how this access, with the participation of Joe Biden, translated into commercial deals down the road.”



Schweizer said this first round of emails published late last week—only a handful of the 26,000 obtained—is just the beginning. There are more, he said, including ones that further illustrate the relationship between Hunter Biden and the ex-wife of the former Moscow mayor Yelene Baturina—a payment from her to Hunter Biden was a major revelation in a recent U.S. Senate report on the Biden family corruption—as well as a clearer, more vivid description of just how the Bidens worked to develop a system to use Joe Biden’s position in government to enrich themselves.

“The emails, there are different types of emails,” Schweizer said. “Many of the emails are the business partners discussing, without Hunter’s participation, what Hunter’s role is in all of this. What’s very clear, and we will have reporting on this at Breitbart, what’s very clear is Hunter brings no money to the table. But he is considered the avenue to the administration. There are emails that talk about how they are going to do business deals where they want to get union pension money and that Hunter is going to leverage the relationships that his dad has with public employee unions to get that money. So part of it is just kind of a feel for what is the Biden business model, and we kind of knew this in a way but here it’s very explicit that it is trading off the Biden name, the Biden connections, and the Biden access. The other way I would categorize this is geographical. The one we have already broke was a story related to China. There are other emails involving China. Hunter Biden’s business associates spoke candidly in emails about Hunter Biden’s role in the business, particularly as it related to foreign ventures, apparently viewing the Biden name as a form of “currency,” and bragging that they had a “direct…pipeline” to the Obama-Biden Administration.

In another email, Hunter Biden’s associates touted Hunter’s access to the White House and contrasted his willingness to “take on risk” with that of Chris Heinz—then-Secretary of State John Kerry’s stepson and a close friend of Biden and Archer—who was uncomfortable with some of their potential partnerships.



In October 2013, Hunter Biden’s associates (including Devon Archer) discussed which one of their corporate vehicles would be appropriate for a new deal they were working on. Archer noted their need to use a “Rosemont Seneca SPV” (also known as a special purpose vehicle) because Rosemont Capital was too close to the Heinz family and because using an SPV could “bring Hunter into the mix.” Archer explained his desire “to leverage Hunter more” in a way that didn’t involve Heinz, who Archer called “much more risk averse.”

Another benefit of the Rosemont Seneca SPV was, per an October 5 email from Hunter Biden and Devon Archer’s business associate Bevan Cooney to Archer, it “would be good to put some honey in Hunter’s pocket.” That same day Archer responded: “Agreed. I also have more autonomy with that company as I own it with Hunter and he’s willing to take on risk… Hunter will work if we need him too [sic] as well.”

Five days later, Biden’s business associate Jason Galanis confirmed to Archer that he had changed the corporate references in the proposal to include a Hunter Biden-controlled firm. Archer replied, clearly pleased. “Perfect. Let’s just keep to that. We get the Biden lift and stay out of Heinz panties.” Archer had noted he would use Rosemont Seneca Partners instead of Rosemont Capital, in which Heinz held a stake. Hunter Biden and Devon Archer’s Rosemont Seneca Partners would play a pivotal role in their future deals.



For example, in December 2013, Rosemont Seneca Partners finalized a deal with the Chinese government-backed investment vehicle, Bohai Harvest, to form Bohai Harvest RST, a new firm in which Hunter Biden would maintain a 10% equity stake and whose funds would grow to at least $1.5 billion.

Soon after that deal (and after Biden and Archer joined the board of Ukraine’s Burisma Holdings), Heinz made moves to sever his formal business ties with Archer and Biden in May 2014. Just hours after Burisma’s announcement that Biden and Archer had joined the board, Heinz emailed top aides for his step-father and then-Secretary of State John Kerry, alerting them to the potentially compromising arrangement. “Apparently Devon and Hunter both joined the board of Burisma and a press release went out today,” Heinz said. “I can’t speak why they decided to, but there was no investment by our firm in their company.”



But Heinz’s concerns apparently did not deter Biden and his associates from continuing to leverage the Biden family name to pursue questionable business arrangements.

In an email on November 4, 2014, Biden’s business associate Jason Galanis discussed a draft pitch that he was preparing for possible investors. Galanis explained that the presentation would cover boilerplate issues like investor protections. But Galanis also sought to emphasize their connections to the White House, specifically Vice President Joe Biden: “I wanted to focus on the ‘other currency’ we are bringing to the table…direct administration pipeline.” Galanis also mentioned dropping Joe Biden’s connections in their pitch when dealing with union pension funds. Galanis wrote, “maybe we should also remind of HB’s dad’s union relationships to justify the ask??”



In a March 2015 draft investor pitch, Biden’s associates wrote about the need to “leverage Hunter Biden Taft Hartley network.” Taft Hartley is the law governing union pension funds, and Joe Biden has a long-established history of close relationships with union bosses, which Hunter Biden and Joe’s brother James Biden have reportedly sought to capitalize on in the past. The presentation noted that the team “led by Archer and Biden” would create “unprecedented opportunity for a firm at our scale,” and referenced tapping finances from Chinese officials. In December 2013, as has been widely reported, Biden and Archer secured a $1 billion private equity deal financed by the Chinese government. Biden and his associates wanted to go back for even more Chinese money.



In the March 2015 draft investor pitch, Biden’s associates outlined the plan to leverage family clout for more foreign cash. In a section outlining where investments would come from, Biden’s associates described capital flowing from “China>USA” and “Former CCP [Chinese Communist Party]>USA.” And the presentation also proposed more cross-border business deals involving “China SOE [State Owned Enterprises]” and “Former CCP Energy.”



The above quotes are taken directly from a trove of 26,000 emails and attachments from Hunter Biden and Devon Archer’s business associate Bevan Cooney. These emails—provided to Schweizer from Cooney via journalist Matthew Tyrmand—are completely separate from the emails released by the New York Post (purportedly derived from a backup of Hunter Biden’s laptop hard drive).

Cooney is currently serving time in federal prison for his role in the tribal bond scheme that also resulted in the conviction of Devon Archer on conspiracy and securities fraud charges. Archer currently awaits sentencing for that conviction.
