Edelman in Court today

More details:

New England Patriots wide receiver Julian Edelman is due in Boston Municipal Court today where he will be arraigned on charges of indecent assault and battery on a woman, according to Suffolk District Attorney Daniel F. Conley’s office.

Boston police spokeswoman Elaine Driscoll said officers were called to the Storyville nightclub on Exeter Street in the Back Bay around 1:30 a.m. today to investigate reports of an assault.

After speaking with the female victim, Edelman was arrested on a single count of indecent assault and battery, Driscoll said. Edelman was taken into custody but later posted bail and was released by police.

Driscoll said out of respect for the confidentiality of the information the victim supplied to police, she would not provide specific details of the allegation against Edelman.

In a report on the case, Boston police said Edelman was inside the nightclub on Halloween night when he allegedly reached underneath the woman’s costume and groped her below the waist.

A man with the woman told police that a man – later identified as Edeleman – bumped into the woman on the dance floor. “He saw the victim’s face change into an expression of shock,’’ police said in the report.

The man then confronted Edelman on the dance floor and “threatened to beat him up’’ while the woman tried to calm him down, police said. The man and the woman were ejected, followed by Edelman, police said.

To calm the situation, the man and the woman and Edelman were thrown out of the nightclub by bouncers, police were told by nightclub staff.

When police arrived, Edelman denied groping the woman, police said.

However, after the man and woman positively identified him, Edelman was charged with indecent assault and battery.
 
Why would the victim and her defender get thrown out of the club??? Wouldn't throwing Edelperson out/arresting him and removing him be the only thing needed to "calm the situation"????

usually when a fight is about to break out it is wise to take both parties and remove them from the establishment so they can beat the shit out of each other off the property.
 
Indecent assault and battery on a person aged fourteen or older is a criminal offense under Massachusetts General Laws Chapter 265 Section 13H. An assault and battery is an intentional and unjustified use of force upon another’s person, however slight. Since violent force is not usually involved in this offense, “force” in this context is usually no more than a touching. An indecent assault and battery is an intentional and unjustified touching of a private area, including, but not limited to, the breast, abdomen, thigh, buttocks, genital or pubic areas of a female or the buttocks, genital or pubic areas of a male. Whether the body part is a “private area” is determined in the context in which the touching occurred.

To be convicted of indecent assault and battery on a person aged fourteen or older, the prosecutor must prove all of the following six elements beyond a reasonable doubt:

1.The alleged victim was over the age of fourteen.
2.The defendant intended to engage in the touching;
3.The defendant committed the touching;
4.The touching was harmful or offensive;
5.The touching was indecent.A touching is indecent when it is contrary to societal norms and is offensive to current moral values in that would be considered “immodest, immoral and improper.” Indecency is measured by “common understanding and practice.” This definition gives persons of normal intelligence an opportunity to know what is proscribed. And;
6.There was no justification or excuse for the touching.

If you are convicted of indecent assault and battery on a person aged fourteen or older, you face imprisonment in the state prison for up to five years or imprisonment in a jail or house of correction for up to two and one-half years.

I have no idea what happened in the Edelman situation........

.....but by reading this definition of the charges.......if this means simply patting a girl on the ass or grabbing a little boobie...... they would have needed a private cell with my name on it back in the day.

Times have changed though.

I think we know which way any establishment will lean.
 
She only had him arrested because when she saw him up close, she realized he wasn't Justin Bieber.

they removed all of them, including Julian and his Posse so the establishment did not show any special treatment of Julian. I assume the man was tossed because the retaliation always gets caught by the refs.
 
usually when a fight is about to break out it is wise to take both parties and remove them from the establishment so they can beat the shit out of each other off the property.

Damn lucky short little Danny Woodhead wasn't there too. Poor kid would be nailed for this every week, just by walking up to a girl and saying 'Hi', because she'd be creeped out by the fact that he was talking to her no-no place. :coffee:
